What are the Consequences of Underage Drinking in Virginia?

Under Virginia Code §4.01-305, it is unlawful for a person under 21 years of age to purchase, consume, or possess alcohol. The penalties may include:

  • Up to 12 months in jail
  • Maximum fine of $2,500; mandatory minimum fine of $500
  • Driver’s license suspension for at least 180 days, up to 1 year
  • 50 hours of community service
  • Alcohol abuse counseling
